EC says Bosnia makes partial progress in legal harmonisation.

The European Commission (EC) concluded that the country had made only partial progress in harmonising the national legislation and transposing the EU legislation related to the internal market and competition. EC acknowledged that the country made some progress in law transposition in the banking sector, insurance and other financial services, but called for better harmonisation of legal acts and their implementation between the two entities. According to the commission, banking supervision on state level was not ensured, which was a drawback, while the public procurement regime needed additional approximation. Authorities achieved good progress in the area of intellectual, industrial and commercial property rights but better coordination in the enforcement of these rules was still a challenge. A certain progress had been made with regard to freedom of establishment, but the procedures for registering a company should be further simplified in both FBiH and RS, the commission added. EC welcomed the progress made in transposition of the EU acquis in the area of company law, accounting and auditing, which will help create a better business environment. At the same time, EC welcomed the good functioning of the Competition Council, but urged authorities to adopt a law on state aid on state level by July 2010.
