One of the major Bosniak parties, the SBiH, prepared draft amendments to the state constitution and election law related to the recent verdict of the European Court of Human Rights. The aim of the proposed amendments was the elimination of the discrimination against Jews and Roma, who were not allowed to run in the previous general elections for members of the presidency and state parliament. SBiHs proposal introduces 4 th member of the state presidency and foresees 3 seats in the state parliament for ethnic minorities, other than the constitutive peoples of Serbs, Bosniaks, and Croats. As recalled, the European Court of Human Rights criticized recently the country for discrimination. The ruling in fact describes the state constitution as discriminating, because of the existence of the term constitutive peoples. We note that the ethnic Serbs, Croats and Bosniaks have equal rights in the electoral system, based on their constitutive people character, while the other ethnic minorities do not have the same rights, according to the countrys primary law.
